What if the other driver does not have insurance?

Texas law requires all drivers to carry fault insurance, but many people still drive without it. If an uninsured driver hits you, you may be able to recover compensation through your own insurance policy if you have Uninsured Motorist (UM) coverage. UM coverage is designed to protect you when the at-fault driver has no insurance. You can also use Underinsured Motorist (UIM) coverage if the other driver insurance is not enough to cover your full damages. Your own insurance company pays the claim, up to your policy limits.   Keep in mind that your own insurance company may still try to minimize what they pay you. What if I was partially at fault for the accident?

Texas follows a modified comparative fault rule, also known as the 51% bar rule. This means you can still recover compensation even if you were partly at fault, as long as you were not more than 50% responsible for the accident.
