Settlement Reached in Teen’s Wrongful Death Case After Hawaii Kayaking Tragedy

A settlement has been reached in the teen’s wrongful death suit filed by the parents of a 15-year-old boy who died after being swept away while on a kayaking and hiking trip in Hawaii. The terms of the settlement between Michael and Marianne Madoff, the boy’s parents, and the defendants—Bold Earth Teen Adventures and Hawaii Pack and Paddle—were sealed.

Accident Details

The Madoffs’ son, Tyler, a student at Scarsdale High School in White Plains, N.Y., was on a hiking and kayaking tour led by Bold Earth on July 4, 2012. After kayaking in Kealakekua Bay, the group was hiking near the Captain Cook monument when they stopped to rest at a tide pool.

The area where tour guides led the group was outside of a state-permitted zone, even though high surf warnings had been issued. Large waves came over the group, and Tyler Madoff was swept out to sea. His body was never recovered.

This heartbreaking incident became a focal point for discussions around outdoor safety and the importance of accountability in teen’s wrongful death cases involving organized adventure tours.

Tour Group Negligence

The family of the teenager swept out to sea while on a hiking and kayaking tour in Hawaii has reached a settlement for his teen’s wrongful death case.

The Madoffs stated that their decision to file the teen’s wrongful death lawsuit was motivated by their desire to prevent other families from suffering a similar tragedy. Attorneys for Bold Earth declined to release a public statement regarding the case.

Awareness Fund

As part of the settlement, Tyler’s parents plan to establish a fund in his name to promote safety awareness in the area where the tragedy occurred. The fund will also support search and rescue efforts to help ensure that future incidents can be responded to more quickly and effectively.

The Madoffs expressed deep gratitude to the search and rescue teams, describing them as “amazing” in their efforts to locate their son, even though his body was never found.
