Parents File Lawsuit After Death of Child at Daycare Facility
The parents of three-year-old Rayne Stanley, who died at the Kidzone Daycare Center in Houston in February 2013, have filed a lawsuit against the facility, claiming negligence in their child’s death.
Rayne, who suffered from severe asthma, died after suffering an asthma attack while at the daycare.
Attack Earlier in the Day
Reports indicate that Rayne had chronic asthma and suffered a small attack earlier that same day. Despite this, she was later left alone in a bathroom, where she suffered another, fatal attack.
The owner of the daycare claims that Rayne’s parents did not inform her about the severity of the child’s asthma. She also stated that she performed CPR in an attempt to save Rayne, calling the incident a “tragic accident.”
Not an Accident, Say Parents
According to Rayne’s parents and their attorney, however, the child’s death was the result of neglect, not an accident.
They say that Rayne was unable to breathe and died alone in the bathroom, unable to open the door or call for help. Their attorney, Jason Gibson, stated that the daycare center was entrusted with Rayne’s care and failed in that responsibility.
Inspection reports from the Texas Department of Family and Protective Services revealed prior citations against the facility, including staff not being certified in first aid the previous year.

According to the Centers for Disease Control and Prevention (CDC), more than 7 million children in the U.S. suffer from asthma, and over 3,000 people die from the disease each year.
Asthma is a lifelong condition that causes coughing, chest tightness, and difficulty breathing. The CDC also reports that asthma rates are increasing, costing the U.S. more than $56 billion annually.
