A Houston man whose repeated attacks with a taser at work were published on YouTube is suing his former employers, says Frenkel & Frenkel.
A Texas State Representative and her husband, who co-own a Houston car dealership are the subjects of a lawsuit filed by a former employee for assault and battery, as well as failing to provide a safe workplace. According to Bradley Jones, his fellow employees began sneaking up on him nine months ago and hitting him with a stun gun. Court documents state that Jones’ boss, Sam Harless, the husband of State Representative Patricia Harless, not only provided the stun gun, but often held the camera many times. The videos were posted on YouTube, and shown on local news media. The Attacks Mr. Jones said the attacks began nine months before, and that he was hit by the stun gun more than a dozen times. He repeatedly attempted to stop the attacks, but they continued. In the videos, Jones can often be seen seated at his desk, sometimes with his back to the door as another employee sneaks behind him, hitting him with the taser. Other employees and the person holding the camera can be heard laughing as Jones cries out. Dealership Response Statements from Representative Harless and her husband claim that the matter is a “frivolous” lawsuit, and that it was filed by a former employee who was terminated “for cause” from Fred Fincher Motors, the dealership co-owned by the couple. The two employees responsible for the stun gun attacks are also named in the lawsuit. Mr. Harless claims that when the facts are presented to the court, the case will be thrown out, despite the video evidence. Could Not Quit According to Mr. Jones, he could not quit his position at the dealership, where he had worked since 2009, because he was in the process of buying a home. Mr. Jones says that he was constantly looking over his shoulder, was unable to sleep and was distracted at work. Although the Harless’ claim that Mr. Jones was fired for cause, there is no information as to why Mr. Jones was let go from the dealership, nor has there been any explanation as to why he was targeted by Mr. Harless and fellow employees. Mr. Jones attorney said that criminal charges may follow regarding the matter. When an employer provides an unsafe workplace that causes mental anguish or injury, a civil lawsuit may be in order.
